Delveng Terms of Use

1. Accounts

You need an account for most activities on the Delveng platform, including accessing content.

• Account Security: You are fully responsible for all activities that occur under your account. You must keep your login credentials confidential and secure.
• Age Requirement: You must be at least 18 years old (or the legal age of majority in your country of residence) to create an account. Individuals under this age are permitted to use the platform only under the direct supervision and guidance of a parent or legal guardian.
• Non-Transferability: Accounts are strictly personal; you may not share your account credentials or transfer the ownership of your account to anyone else under any circumstances.
• Account Termination: Delveng reserves the right to terminate or suspend your account in the event of a violation of any of these rules and terms.

2. Content Enrollment and Access

• Nature of License: When you enroll in any course or content, you are granted a limited license by Delveng to view and access the content solely for your personal, educational purposes. You do not acquire ownership rights to this content.
• Access Period: "Access" is granted according to the clearly defined and agreed-upon timeframe specified during the purchase or subscription process.
• Unauthorized Use: Both students and instructors are strictly prohibited from sharing, reselling, licensing, or distributing the content available on the platform in any manner whatsoever.

3. Payments, Credits, and Refunds

• Payment Methods and Pricing: You must use valid and approved payment methods. Prices for services and content may vary depending on the platform used (web or mobile apps), active promotional offers, or your geographic location.
• Refund Policy: Generally, a refund for paid amounts is available within 30 days of the purchase date, provided that the refund criteria are met.
• Promotional Offers: Gift codes, vouchers, and promotional offers are subject to specific rules and validity periods set at the time of issuance.
• Abuse of Policy: If Delveng discovers any abuse of its refund policy (e.g., consuming a significant portion of the content and then requesting a refund), it reserves the right to deny future refund requests, restrict access, or permanently ban the account.

4. Content and Behavior Rules

All users must comply with local and international laws, as well as Delveng's Trust and Safety guidelines.

• Students: You must strictly respect the copyrights and intellectual property rights of the content and the instructors.
• Instructors: You are strictly prohibited from publishing any content that is illegal, offensive, or infringes upon the intellectual property or privacy rights of any third party.
• Personal Interactions: Users bear full responsibility for their personal interactions with one another within the platform's community. Delveng assumes no legal or moral liability for these interactions.
• Removal Rights: Delveng may remove any content or immediately ban any account without prior notice if any violations of these rules are detected.

5. Delveng's Rights to Content

Users (students) retain the right to browse and view the content made available to them according to the granted licenses, while Delveng retains all organizational and operational rights related to managing and broadcasting this content through its systems.

6. Using the Platform at Your Own Risk

• Nature of Content: The content is created and provided by independent instructors and experts. The platform provides this content on an "as is" basis, and Delveng assumes no liability for any errors it may contain, whether concerning scientific, practical, or legal accuracy.
• Assumption of Risk: Users assume all risks associated with accessing the training courses or relying on the coaching services provided.
• Privacy and External Links: We strongly advise caution when sharing any personal information with other users. Furthermore, your use of links leading to external websites or advertisers within the platform is strictly at your own personal risk.

7. Platform Rights

• Ownership: Delveng owns all rights, titles, and intellectual property associated with the platform, its applications, databases, and proprietary content (including logos and designs).
• Prohibited Activities: Under no circumstances may users tamper with systems, reverse engineer, copy source code, or use automated data scraping tools. Engaging in any unauthorized or disruptive activities that could harm the platform's infrastructure is strictly prohibited.

8. Subscription Terms

• Licenses: Subscription plans are provided as described, and each topic or course is priced as clearly displayed on the platform. This license is limited, temporary, and non-modifiable.
• Additional Features: Subscriptions may include access to Generative Artificial Intelligence (GenAI) features, which are subject to specific rules and restrictions. Commercial use of these sessions, inputting sensitive personal data into them, or using them in a manner that causes technical malfunctions to the platform is not permitted.
• Billing and Cancellation: Specific rules apply to free trials, certain free open-access tasks, automatic subscription renewals, and billing. Delveng may cancel or restrict access to subscription content at any time for legal, political, or operational reasons.

9. Gifts and Reward Vouchers

Delveng values user engagement and achievements by offering rewards, vouchers, and gifts. These benefits are subject to the following guidelines:

• Achievement-based Rewards (Vouchers): Upon completing specific educational or interactive milestones determined by the platform, a user may be granted reward vouchers; such as the right to "invite a friend" to join the platform or to access specific content for free. These vouchers are valid for use in accordance with the announced terms and are subject to an expiration date set at the time of issuance.
• Survey Gifts: In appreciation of users' contributions to the platform's development, Delveng may grant gifts or promotional credits to users who complete opinion surveys and platform evaluations. These gifts are awarded according to the guidelines and conditions outlined in each survey.
• General Terms for Rewards: All gifts, vouchers, and rewards are non-redeemable for cash and non-transferable to another user (unless explicitly stated otherwise). Delveng reserves the absolute right to cancel or revoke any gifts or vouchers if any manipulation, fraud, or violation of the Terms of Use is discovered.

10. General Legal Terms

• 10.1 Binding Agreement: Your use of the platform constitutes a legally binding contract. In the event of a conflict between translated versions, the version (English/Arabic - as determined by the platform) shall prevail. These Terms represent the entire agreement between you and Delveng.
• 10.2 Disclaimers: The platform and its services are provided on an "as is" basis without express or implied warranties regarding accuracy, security, or uninterrupted availability. The platform bears no responsibility for any indirect, incidental, or consequential damages resulting from the use of the services.
• 10.3 Limitation of Liability: Delveng's maximum liability to you in any financial claim shall be limited to the price paid for the subscription or the total amount you paid to the platform during the last month preceding the dispute.
• 10.4 Indemnification: You agree to defend and indemnify Delveng against any claims or damages arising from: your content, your use of the platform, your violation of these Terms, or your infringement of any third-party rights.
• 10.5 Governing Law and Jurisdiction: Local laws apply based on the user's geographic location (e.g., for users in Egypt: Egyptian Law applies). The courts specified by law shall have exclusive jurisdiction to resolve disputes.
• 10.6 Notices: Any notices or legal proceedings must be in writing and sent via the platform's official email or registered mail.
• 10.7 Relationship of Parties: These Terms do not create any partnership, agency, or employment relationship between you and Delveng.
• 10.8 Non-Transfer: You may not assign or transfer your rights or obligations under this contract to any other person. Conversely, Delveng may transfer or assign its rights to any entity.
• 10.9 Recommendation Systems: The platform suggests personalized content to you based on the analysis of your behavior, interactions, and searches within the platform.

11. Dispute Resolution

• 11.1 General Principles: In the event of any dispute, we are committed to attempting to resolve it amicably first by contacting the "Technical Support" team. Unresolved issues may be escalated to the platform's internal legal review.
• 11.2 Individual Mediation and Arbitration: Intractable disputes that have not been resolved amicably may be referred to binding individual arbitration. Each party shall bear its own legal costs and fees unless applicable law dictates otherwise. Class Actions are strictly prohibited, and you may not join any class action lawsuit against the platform.
